These Terms of Use govern your access to and use of the FlyLUCIA mobile app and related services. By creating an account, subscribing, or otherwise using FlyLUCIA, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the app.
FlyLUCIA is operated by António Aires, based in Portugal (Av. Estados Unidos da América n39A, 1700-165, Portugal). In these Terms, "FlyLUCIA", "we", "us", and "our" refer to António Aires. "You" means the individual using the app.
These Terms form a binding agreement between you and us. They apply from the effective date above and replace any earlier terms of use for the app.
Our Privacy Policy explains how we handle personal information. It is incorporated into these Terms by reference.
You accept these Terms when you tap to agree during onboarding, create an account, start a subscription, or continue using FlyLUCIA after we publish an update.
We may update these Terms from time to time. When we do, we will revise the effective date and make the updated Terms available in the app. If changes are material, we will take reasonable steps to let you know. Continued use after an update means you accept the revised Terms, to the extent permitted by law.
FlyLUCIA is intended for people aged 18 and over who work in airline crew roles or otherwise use the app for legitimate crew-life purposes.
You confirm that you meet this age requirement and that the information you provide is accurate. You may not use FlyLUCIA if you are barred from doing so under applicable law or if we have suspended or closed your account.
FlyLUCIA is a crew-life app that helps you manage roster-related information, plan days off, connect with other crew members, and coordinate swap requests.
Features may include roster entry and viewing, friend connections, swap workflows, push notifications, profile and account settings, and paid subscription features.
We may add, change, or remove features at any time. We do not guarantee that any particular feature will always be available.
FlyLUCIA is an independent app. It is not affiliated with, endorsed by, sponsored by, or operated on behalf of any airline, employer, union, or aviation authority.
FlyLUCIA does not replace your airline's official roster systems, scheduling tools, HR platforms, or internal swap policies. You remain solely responsible for understanding and complying with your employer's rules, contractual obligations, licensing requirements, and any procedures that apply to your duties, days off, and schedule changes.
You must not represent that FlyLUCIA speaks for your airline or that using the app satisfies any official employer requirement unless your employer has explicitly confirmed that in writing.
FlyLUCIA helps crew members coordinate swap requests and related roster information. The app is a facilitation tool only.
We do not guarantee that any swap will be accepted, completed, approved by an employer, or result in a schedule change. We are not responsible for crew decisions, misunderstandings between users, employer approvals or rejections, operational disruptions, or any consequences arising from roster or swap activity.
You are solely responsible for verifying roster accuracy, confirming counterpart details, and ensuring that any swap or schedule change complies with your employer's policies before relying on it.
You are responsible for maintaining the confidentiality of your sign-in credentials and for all activity under your account.
You agree to provide accurate account and profile information and to keep it reasonably up to date.
You may not share your account, impersonate another person, create an account for someone else without authority, or use another person's account without permission.
Notify us promptly through Help & support if you believe your account has been accessed without authorization.
You may enter or upload information in FlyLUCIA, such as roster details, profile information, photos, swap messages, and other content ("Your Content").
You retain ownership of Your Content. You grant FlyLUCIA a limited, worldwide, non-exclusive license to host, store, process, display, and share Your Content only as needed to operate the service — for example, to show your chosen roster information to friends or swap counterparts, deliver notifications, or back up your account.
You represent that you have the right to provide Your Content and that doing so does not violate any law, employer rule, or third-party right.
You agree to use FlyLUCIA lawfully and respectfully. You may not use the app to harass, threaten, abuse, stalk, or defame any person; promote hate or discrimination; or impersonate any individual or organization.
You may not post or share content that is illegal, fraudulent, deceptive, or malicious, including malware, phishing, or spam.
You may not share another person's personal, confidential, or employer-restricted information without appropriate consent.
You may not scrape, reverse engineer, decompile, probe, or attempt to derive source code from the app except where applicable law expressly allows it.
You may not interfere with the app's operation, bypass access controls, or use automated means to access the service without our permission.
We may investigate violations and suspend or terminate access where we reasonably believe these Terms or applicable law have been breached.
When you connect with other users, limited information you choose to share — such as days off visible to friends or roster details needed for an accepted swap — may be shown to those users. Other users cannot browse or search for your profile outside permitted in-app flows.
FlyLUCIA may ask for your Instagram username so crew members can reach you about swaps. Communication on Instagram or any other third-party platform happens outside FlyLUCIA and is at your own risk. We are not responsible for messages, conduct, or outcomes on Instagram or other external services.
You are responsible for what you share and with whom you connect.
Some FlyLUCIA features require a paid subscription. Subscriptions are sold through the Apple App Store and processed by Apple. We do not collect or store your full payment card details.
When available, FlyLUCIA may offer a free trial (currently three days). If you start a free trial and do not cancel before it ends, your subscription automatically renews as a paid subscription at the price shown in the app at the time of purchase, unless Apple's subscription settings or applicable store rules provide otherwise.
You can manage or cancel your subscription in your Apple ID account settings. Deleting the app does not cancel your subscription.
Prices, trial length, and plan details may change for new purchases. Apple handles billing, renewals, and refunds according to its policies.
If you create an account but do not start or maintain an active subscription, your account and associated data may be removed automatically after three days, unless we state otherwise in the app.
From time to time, FlyLUCIA may offer promotional or discount codes. Unless we say otherwise in writing, each code is limited to one redemption per user, is non-transferable, has no cash value, and may not be combined with other offers.
We may modify, suspend, or revoke any code at our discretion. Codes are subject to availability and any additional terms presented when you apply them.
FlyLUCIA may let you invite other crew members to join the app. You agree to send invites only to people you know, without spam, misrepresentation, or unsolicited bulk messaging.
You may not use invite or referral features for unlawful marketing, impersonation, or abuse. We may limit, suspend, or discontinue invite programs at any time.
FlyLUCIA, including its name, branding, design, software, and content we provide, is owned by us or our licensors and is protected by intellectual property laws.
Except for the limited rights expressly granted in these Terms and in Apple's Standard EULA, no rights are transferred to you.
If you send us feedback or suggestions, you grant us a perpetual, royalty-free license to use them without restriction or compensation to you.
FlyLUCIA relies on third-party services such as Apple, Supabase, RevenueCat, PostHog, and Instagram. Your use of those services may be subject to their own terms and policies.
We are not responsible for third-party services, websites, or content accessed through or outside the app.
FlyLUCIA is made available through the Apple App Store. Your license to install and use the app on Apple devices is governed by Apple's Licensed Application End User License Agreement (Standard EULA), available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/, unless a custom EULA is provided in App Store Connect.
You acknowledge that these Terms are between you and FlyLUCIA, not Apple. Apple is not responsible for FlyLUCIA or its content, maintenance, support, product claims, or legal compliance.
To the maximum extent permitted by applicable law, Apple has no warranty obligation whatsoever with respect to FlyLUCIA. Apple is not responsible for addressing any claims relating to FlyLUCIA, including product liability, legal compliance, consumer protection, or intellectual property claims.
Apple and its subsidiaries are third-party beneficiaries of Apple's Standard EULA and may enforce it against you as a third-party beneficiary.
You represent that you are not located in a country subject to a U.S. Government embargo or designated as a U.S. Government prohibited or restricted party.
You must comply with applicable third-party terms when using FlyLUCIA, including Apple Media Services Terms and any applicable wireless data service agreement.
FlyLUCIA is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.
We do not warrant that the app will be uninterrupted, error-free, secure, or free of harmful components, or that roster or swap information will be accurate or complete.
Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.
To the maximum extent permitted by law, FlyLUCIA and António Aires will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or business opportunity, arising out of or related to your use of the app.
To the maximum extent permitted by law, our total liability for any claim arising out of or relating to FlyLUCIA or these Terms will not exceed the greater of (a) the amount you paid us for the subscription giving rise to the claim during the six months before the claim arose, or (b) fifty U.S. dollars (USD 50).
Nothing in these Terms limits liability that cannot be limited under applicable law, including mandatory consumer rights in the European Union.
You agree to indemnify and hold harmless FlyLUCIA and António Aires from claims, losses, liabilities, and expenses (including reasonable legal fees) arising out of your use of the app, Your Content, your violation of these Terms, or your violation of any law or third-party right.
You may stop using FlyLUCIA at any time and may delete your account from Help & support in Profile, subject to our Privacy Policy.
We may suspend or terminate your access if we reasonably believe you violated these Terms, created risk for us or other users, or where required by law.
Upon termination, your right to use the app ends. Provisions that by their nature should survive — including disclaimers, limitations of liability, indemnity, and governing law — will survive.
These Terms are written in English, which is the governing language of the agreement.
Except where mandatory consumer protection law requires otherwise, these Terms and any dispute arising from them are governed by the laws of Portugal, without regard to conflict-of-law rules.
If you are a consumer in the European Union, you may also benefit from mandatory protections of the country where you live, and you may bring claims in the courts of your country of residence where those protections apply.
Before starting formal proceedings, we encourage you to contact us so we can try to resolve the issue in good faith.
